1. Introduction and Acceptance of Terms

Aroma Wellness (“we,” “us,” “our,” or the “Business”) is a professional wellness establishment dedicated to delivering high-quality, therapeutic massage services designed to promote relaxation, alleviate muscular tension, and support overall physical and emotional well-being. Our service offerings include, but are not limited to: Swedish Massage, Effleurage Massage, Sports Massage, Shiatsu Massage, Therapeutic Massage, Neck and Shoulder Massage, Full Body Massage, and Deep Tissue Massage.

These Extended Terms and Conditions (“Terms”) form a legally binding agreement between you (“Client,” “you,” or “your”) and Aroma Wellness governing all aspects of your interaction with our business—including scheduling, attending, paying for, and receiving any of our services, whether in person at our premises, via telephone, email, online booking systems, third-party applications, or any future digital interface we may adopt.

By engaging with Aroma Wellness in any capacity, booking an appointment, completing a health intake form, entering our facility, communicating with our staff, or making a payment, you expressly acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms in their entirety. If you do not agree with any part of this agreement, you must immediately discontinue all use of our services and refrain from booking or attending any session.

These Terms are to be read in conjunction with our Privacy Policy (available upon request at reception, via email, or on our official website, if maintained), which details how we collect, use, disclose, and protect your personal and sensitive health information. Together, these documents constitute the full understanding between you and Aroma Wellness.

2. Eligibility and Capacity to Contract

You must be at least 18 years of age to book, pay for, or receive any service from Aroma Wellness. By making a reservation or attending a session, you affirm that you are of legal age and possess the mental and legal capacity to enter into a binding contract. You further confirm that you are not under the influence of alcohol, non-prescribed drugs, or any substance that impairs your judgment or ability to provide informed consent at the time of service.

Aroma Wellness does not provide services to minors under any circumstances, regardless of parental consent, due to liability, regulatory, and professional ethical considerations.

3. Appointment Booking and Scheduling Procedures

Appointments may be scheduled through any of the following methods: in-person at our reception desk, via telephone, through our official website (if available), via email, or through integrated third-party platforms such as Mindbody, Square Appointments, or Acuity Scheduling.

  • Booking Confirmation: While we endeavor to send automated or manual confirmation messages (via SMS or email), it remains your sole responsibility to verify the date, time, service type, and therapist assigned. Aroma Wellness is not liable for missed appointments due to unconfirmed or misunderstood booking details.
  • First-Time Client Requirements: New clients are required to complete a confidential Health Intake Form prior to their initial session. This form must be filled out honestly and completely. Incomplete or misleading information may result in the therapist declining to provide service for safety reasons, without obligation for refund or rescheduling.
  • Late Arrival Policy: Punctuality is essential to ensure fairness to all clients and therapists. If you arrive late, your session will still conclude at the originally scheduled end time to avoid disrupting subsequent appointments. The full session fee will be charged regardless of the shortened duration. We recommend arriving 5–10 minutes early to allow time for check-in and transition.
  • Therapist Assignment and Substitution: While we make every effort to honor therapist preferences, Aroma Wellness reserves the right to assign an alternative licensed and qualified massage therapist due to unforeseen circumstances such as illness, emergency, scheduling conflicts, or operational needs. All therapists employed or contracted by Aroma Wellness meet or exceed local licensing and professional standards.

4. Cancellation, Rescheduling, and No-Show Policy

To ensure fairness, operational efficiency, and respect for our therapists’ time, the following policies apply to all appointments:

  • Standard Cancellation Window: Cancellations or requests to reschedule must be received at least 24 hours prior to the scheduled appointment start time.
  • Late Cancellations: Cancellations made less than 24 hours before the appointment will incur a cancellation fee equal to 100% of the booked service’s full price.
  • No-Shows: Failure to attend a scheduled appointment without any prior notice constitutes a “no-show” and will result in an automatic charge of 100% of the session cost to the payment method on file or via invoice.
  • Emergency Exceptions: In extraordinary circumstances—such as hospitalization, acute illness, or verified family emergencies—we may, at our sole and absolute discretion, waive the cancellation fee. Documentation (e.g., a doctor’s note) may be requested.
  • Repeated Violations: Clients with two or more late cancellations or no-shows within a 12-month period may be required to provide full prepayment for all future bookings or may be restricted from booking online, limited to phone-only reservations, or, in severe cases, denied future service.
  • Same-Day Bookings: Appointments made and canceled on the same day are considered late cancellations and subject to the full fee.

All cancellation fees are non-refundable and non-transferable to other services or individuals.

5. Payment Terms, Pricing, and Financial Policies

  • Pricing Transparency: All service prices are clearly displayed at our reception area, on our website (if applicable), or within our booking system at the time of reservation. Prices are subject to change without prior notice; however, the rate quoted at the time of confirmed booking will apply to that session.
  • Accepted Payment Methods: We accept cash, major credit/debit cards (Visa, Mastercard, American Express, Discover), digital payment services (Apple Pay, Google Pay, etc.), and valid Aroma Wellness gift cards or vouchers. All card transactions are processed through PCI DSS-compliant secure payment gateways.
  • Prepayment and Deposits: Aroma Wellness may require prepayment or a deposit for:
    • Extended sessions (e.g., 90+ minutes)
    • Package deals or multi-session bundles
    • Peak-hour or weekend appointments
    • Clients with a history of cancellations or unpaid fees
  • Gift Cards and Promotional Vouchers:
    • Gift cards are non-refundable, non-exchangeable for cash (except where required by law), and cannot be replaced if lost, stolen, or damaged.
    • Gift cards expire 12 months from the date of issuance unless prohibited by local consumer protection laws.
    • Promotional offers (e.g., “first-time client discount,” seasonal specials) are subject to availability, valid for new clients only unless stated, and may not be combined with other offers.
  • Gratuity Policy: Tips for massage therapists are entirely voluntary and never included in the service price. If you choose to provide a gratuity, it is customary but not expected, and should reflect your personal satisfaction with the service. Tips go directly to the therapist unless otherwise arranged.

6. Client Responsibilities and Expected Conduct

Your cooperation is essential to maintaining a safe, respectful, and healing environment for all:

  • Honest Health Disclosure: You are solely responsible for providing accurate, current, and comprehensive information about your physical and mental health status. This includes, but is not limited to: injuries, surgeries, chronic conditions (e.g., diabetes, hypertension, cancer), pregnancy, skin disorders, allergies (especially to oils, lotions, or essential oils), medications (e.g., blood thinners), and psychological conditions. Concealing or falsifying this information may lead to serious health risks and absolves Aroma Wellness of liability for any resulting harm.
  • Personal Hygiene and Health Status: Clients are expected to maintain basic personal hygiene. If you are experiencing symptoms of a contagious illness (e.g., fever, cold, flu, open sores, rashes, fungal infections, or gastrointestinal distress), please reschedule your appointment. The therapist reserves the right to refuse service without penalty if such conditions are observed upon arrival.
  • Appropriate Behavior: Discriminatory language, sexual innuendo, aggressive behavior, verbal abuse, intoxication, or any conduct that makes staff or other clients uncomfortable is strictly prohibited. Aroma Wellness maintains a zero-tolerance policy for harassment or misconduct. In such cases, the session may be terminated immediately without refund, and the client may be permanently barred from future services.
  • Privacy and Quiet Environment: To preserve the tranquil atmosphere essential to therapeutic massage, clients are asked to silence mobile phones, avoid loud conversations in treatment areas, and respect the privacy of other guests. Photography, audio/video recording, or unauthorized use of our premises for social media is strictly forbidden without prior written consent.

7. Scope of Services, Limitations, and Professional Boundaries

  • Wellness, Not Medical Treatment: The services provided by Aroma Wellness are for relaxation, stress reduction, and general wellness purposes only. They are not a substitute for medical diagnosis, treatment, or professional healthcare. Our therapists do not prescribe medications, diagnose conditions, or claim to cure diseases. Always consult your physician before receiving massage if you have serious health concerns.
  • Contraindications and Therapist Discretion: Licensed massage therapists are trained to identify conditions that may make massage unsafe (absolute or relative contraindications). Examples include: acute injuries, deep vein thrombosis, uncontrolled hypertension, fever, infectious skin conditions, recent surgery, or certain stages of cancer. If such conditions are present or suspected, the therapist may modify the session or decline service entirely. This decision is made in your best interest and is final.
  • Professional Draping and Modesty: At all times during your session, you will be properly draped with clean sheets or towels in accordance with industry standards and local regulations. Only the area being worked on will be exposed. You may request adjustments to draping, pressure, room temperature, lighting, or music at any time. Your comfort and consent are paramount.
  • Prenatal and Special Populations: Prenatal massage is available only for clients in their second or third trimester and requires prior written approval from your obstetrician or midwife. Proof may be requested. Similarly, clients with complex medical histories may be asked to provide a note from their healthcare provider authorizing massage therapy.
  • Session Boundaries: Our therapists are trained professionals who adhere to strict ethical and professional codes of conduct. Any request for services outside the scope of therapeutic massage will be denied, and the session may be terminated without refund.

8. Limitation of Liability and Assumption of Risk

  • Inherent Risks: While massage therapy is generally safe, it involves physical manipulation of soft tissues and may carry minimal risks such as temporary soreness, bruising, or emotional release. By receiving services, you acknowledge these inherent risks and voluntarily assume them.
  • No Guaranteed Outcomes: Individual responses to massage vary. Aroma Wellness makes no representations or warranties regarding specific health benefits, pain relief, or therapeutic outcomes.
  • Exclusion of Liability: To the maximum extent permitted by applicable law, Aroma Wellness, its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to lost wages, emotional distress, aggravation of pre-existing conditions, or dissatisfaction with service—arising out of or related to your use of our Services.
  • Release of Claims: In consideration for receiving services, you hereby release and forever discharge Aroma Wellness and its representatives from any and all claims, demands, or causes of action related to ordinary negligence, provided that the therapist acted within their professional scope of practice and in accordance with accepted industry standards.
  • Exceptions: Nothing in these Terms shall limit or exclude liability for death or personal injury resulting from gross negligence, willful misconduct, fraud, or any liability that cannot be lawfully limited under applicable consumer protection or health regulations.

9. Intellectual Property and Brand Usage

All content associated with Aroma Wellness—including but not limited to our name, logo, service descriptions, website design, marketing materials, session protocols, and educational content—is the exclusive intellectual property of Aroma Wellness or its licensors. This material is protected under copyright, trademark, and unfair competition laws. You may not copy, reproduce, distribute, display, or create derivative works based on any of our proprietary content without our prior written permission.

10. Use of Third-Party Booking Platforms and External Services

If you book through external platforms (e.g., Groupon, Google Reserve, Yelp Reservations, or wellness apps), you agree that:

  • Those platforms operate under their own terms, privacy policies, and fee structures.
  • Aroma Wellness is not responsible for technical errors, pricing discrepancies, or service failures originating from third-party systems.
  • Our cancellation, no-show, and service policies (as outlined herein) take precedence over any conflicting terms from external platforms.
  • We reserve the right to verify the validity of any voucher or promotional code before rendering service.

11. Amendments and Updates

Aroma Wellness reserves the right to amend, update, or revise these Terms at any time, with or without prior notice, to reflect changes in law, regulation, business practices, service offerings, or operational requirements. Revised Terms will become effective immediately upon posting in our reception area or on our official website (if maintained). Your continued use of our Services after such changes constitutes your acceptance of the updated Terms. For material changes affecting client rights or obligations, we will make reasonable efforts to notify clients via email or in-session notice.

12. Governing Law, Jurisdiction, and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state, province, or country where Aroma Wellness is legally established and operates (e.g., the State of California, USA, or the Province of Ontario, Canada). Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved as follows:

  • Negotiation: Parties agree to first attempt to resolve disputes through good-faith discussion within 30 days of notice.
  • Mediation: If unresolved, parties may pursue mediation with a mutually agreed-upon neutral third party.
  • Legal Action: As a last resort, disputes may be submitted to the appropriate small claims court or civil court in the jurisdiction where Aroma Wellness operates. You waive any right to participate in class-action lawsuits or jury trials related to these Terms, to the extent permitted by law.

13. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be illegal, void, or unenforceable, that provision shall be deemed severed from the agreement and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

14. Entire Agreement and Waiver

These Terms, together with our Privacy Policy and any signed client consent or intake forms, constitute the complete and exclusive agreement between you and Aroma Wellness regarding the subject matter herein. They supersede all prior or contemporaneous understandings, representations, negotiations, or agreements—whether oral, written, or implied.

The failure of Aroma Wellness to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Aroma Wellness to be valid.
